Texas man chokes on marijuana during traffic stop

A Texas man recently tried to eat his stash of marijuana during a traffic stop however he ended up choking on it instead.

Quinton Duane Baker, 38, was stopped by police in north Austin for an undisclosed reason according to KRON.

As the officer approached the car, he stated that he could smell marijuana. The officer also said he saw small green leaves on Baker’s shirt and that the suspect was “feverishly chewing something in his mouth.”

The officer commanded Baker to exit the vehicle and open his mouth. As Baker exited his vehicle, he quickly took several drinks. As Baker exited the vehicle he began to choke on the contents in his mouth and spit it up.

Within a pool of spit on the ground the officers collected what they suspect was marijuana.

The officer said he also saw a green substance in Baker’s cheek and in his teeth. Baker has been charged with tampering with physical evidence, a third-degree felony.

Texas Department of Public Safety records show Baker has two previous convictions, including one for possession of marijuana and another for evading arrest.

    Ok How was he Tampering with evidence.. They got the evidence Form the ground and from his teeth and mouth. Besides Evidence is not evidence unless they attain it 1st. and once they obtain it you cant tamper with what they obtain because then they got it. its not like Walking into a house finding someone dead and then trying to clean it up. he was Eating his Pot. You didn’t have evidence of it till he spit it up. outside of what you could see and smell. So no he was not tampering with evidence. he was trying to keep there form being any. That’s not the same thing as tampering with evidence. Tampering with evidence is what the law does when they try to make Something Disappear or Add to it to make it seem worse then it really is, that’s tampering with evidence! What he did was not!

    If Texas would just get with the program and stop demonizing possession and use of a healing plant, this guy wouldn’t have felt the need to put his safety at risk in the first place by scarfing it down.
